Is Marijuana Legal In Wisconsin?
The simple answer to the question asking if marijuana is legal for recreational use is 'no'. And to answer the question whether or not marijuana is legal for medial use is 'mostly no'.
Wisconsin Marijuana Penalties
Possession of any amount of marijuana is punishable by up to 6 months in prison and a $1000 fine for a first offense. A second offense is punished as a felony with up to 3.5 years in prison and up to a $10,000 fine.
Wisconsin has no laws making marijuana legal for recreational use.
Wisconsin Decriminalizes CBD Products
While Wisconsin has decriminalized CBD products, Wisconsin is still far from legalizing marijuana for recreational or unfettered medical use. (See History Of Marijuana Laws).
Wisconsin Marijuana Laws History
In 1935, Wisconsin legislation prohibited the possession of cannabis.
Assembly Bill (A.B.) 726, which became Wisconsin Act 267, was passed on April 16, 2014. It relates to cannabidiol (CBD) and its use in treating seizure disorders. The Act also included provisions for dispensing CBD and trying to distinguish specialized CBD to not be considered in certain contexts, and to help physicians apply for investigation drug permits for CBD treatment.
In 2017, Governor Scott Walker signed Act 4 into law to expand the existing CBD law, allowing patients with any medical condition to access CBD with no psychoactive effect. (Wisconsin State Cannabis org).

Marijuana Use Illegal In Wisconsin
Aside from the very limited permissions of CBD for medical purposes, all other activities are illegal. It is still illegal in Wisconsin to grow, manufacture, distribute, sell, deliver, or traffic marijuana or operate a home where it is grown and products are manufactured. Such acts are Felony offenses. Any offense with marijuana committed in the presence of a minor is a Felony offense.
